L.A. Moves to Shut Down Medical Marijuana Dispensaries |

With hundreds of medical marijuana dispensaries operating across Los Angeles in violation of a moratorium, the City Council has set the stage to start enforcing the ban, which went into effect almost 21 months ago. The city clerk has notified 14 dispensaries that their requests for exemptions from the moratorium will be considered by the City Council on Tuesday. Most, if not all, are likely to be denied on the grounds that they were not registered with the city by the moratorium’s deadline in 2007. A denial would allow the city’s code enforcement bureau and the city attorney to take legal steps to force them to shut down. The city allowed 186 existing dispensaries to stay open under the moratorium. Since then, 532 dispensaries have asked the council for exemptions that would allow them to operate. Most of those have opened without waiting for permission. That has triggered concerns from activists in neighborhoods in which they have clustered. The city is still developing regulations to control where dispensaries can open. Councilman Ed Reyes, who heads the committee that oversees the moratorium, promised earlier this week to start reviewing the exemption applications. The council has ruled on none of them. That has hampered enforcement. The city attorney’s office says it would be hard to make a case that a dispensary should be shut down when it had an exemption request pending before council. Since Tuesday, when Reyes said he would start to deal with the applications, two dozen more dispensaries filed for exemptions, almost double the number the council will consider next Tuesday. It will also vote on whether to stop accepting new applications for exemptions. Four years ago, when the Los Angeles City Council started to wrestle with how to control medical marijuana, there were just four known storefront dispensaries, one each in Hancock Park, Van Nuys, Rancho Park and Cheviot Hills.
Now, police say there are as many as 600. There may be more. No one really knows.

"The city of L.A. has failed us on this issue," said Michael Larsen, public safety director with the Eagle Rock Neighborhood Council. "There's a huge loophole. L.A. city's not watching. L.A. city's not enforcing."
No other city in California has seen such uncontrolled growth in dispensaries. As signs featuring the easily recognized saw-toothed cannabis leaf multiplied on commercial strips, neighborhood activists like Larsen began to ask their council members why the city was not shutting down dispensaries that opened after the moratorium.
Larsen was shocked at the answer. "Nothing controls these," he said. |

As many people have fallen victim to the downtown economy, there seems to be a particular enterprise that is booming – at least along Pico Blvd. It’s Medical Marijuana Dispensaries. Now I’m sure there are those who are genuinely afflicted with an ailment that requires the relief that medical marijuana affords them. Therefore it would be reasonable to assume, based on national statistics of illnesses that commonly prescribe medical marijuana (AIDS, glaucoma, cancer, multiple sclerosis, epilepsy, and chronic pain to name a few), that an area the size of the Pico Neighborhood Council community would have roughly 375 people(1) that would have a genuine need to light up or have a brownie. It’s also reasonable to assume that this client base can be easily accommodated by 1 or 2 medical marijuana dispensaries. After all, we have only 1 CVS and 1 Wal-Greens who offer a plethora of drugs to service our community. Well, folks, we have not 1 but 15 establishments who have setup shop. This equates to 1 every 2 blocks between Fairfax & LaBrea! With a moratorium that has been, and continues to be, in place since September 2007, one has to ask, ‘How did this happen?’ Such a small legal client-base couldn’t possibly sustain 15 independent dispensaries. Hmm.. there must be something else going on. Clearly they must be profitable since one of the more recent applications was filed by a Beverly Hills CPA firm under a separate Limited Liability Corporation. |

LOS ANGELES (CNS) -- A Los Angeles City Council committee today will consider eliminating a loophole that would allow nearly 500 medical marijuana dispensaries to operate despite a temporary ban that went into effect in the fall of 2007. Two years ago, the city council approved a temporary moratorium on new medical marijuana dispensaries. The purpose of the interim ordinance, which will expire on Sept. 14, was to give city leaders time to draft regulations that limit where and how dispensaries can operate in Los Angeles. California voters 13 years ago approved Proposition 215, which made it legal to sell marijuana to certain patients with a doctor's prescription. The drug is still considered illegal under federal law and Drug Enforcement Administration agents have raided dispensaries throughout Southern California. But Attorney General Eric Holder recently announced those raids would end. |

On Thursday, May 14 at 8 PM, KCET-TV Channel 28 aired it's program "SoCal Connected" that featured an exclusive segment from Judy Muller as she investigates charges that L.A. has become “the magnet for medical marijuana dispensaries” with local residents blaming city officials for “pot clinics gone wild.” In fact, Muller reports that there are more pot clinics in Los Angeles than there are Starbucks. Called “Up in Smoke,” SoCal Connected asks if some clinics are taking advantage of loopholes in the law; Are city officials unwilling or unable to enforce their own ban on new medical marijuana clinics? And why are city officials so unwilling to talk about the issue?
